NASHVILLE, TN:   Update on the Nashville Gun Show ban June 15, 2017...

On June 15, 2017, the Tennessee Court of Appeals issued an opinion regarding the challenge by Tennessee Firearms Association and the Bill Goodman Gun and Knife Shows to the action by

the Metro Fair Board to stop leasing space at the publicly owned fairgrounds in Nashville to anyone who wanted to conduct a gun show event.

The court of appeals concluded, in summary, that neither TFA nor the Goodman plaintiffs had “standing” to question whether Metro was violating the law.  This determination has shocked

many 2nd Amendment supporters and should shock other supporters of the fairgrounds because it effectively means that Metro government can ignore a public referendum that was

enacted specifically to prohibit Metro government from doing what it did shortly after Megan Barry became mayor – prohibiting activities at the fairgrounds that had previously been a

regular and extremely popular occurrence. 

 

The actions by Metro are believed to be the basis for a change in state law that just went into effect in June 2017 which now expressly provides that individuals and entities, such as TFA

and Goodman, would have “standing” as a matter of law to challenge violations of the state pre-emption act.  That state law also now provides that if a successful challenge is made

that the local government entity could be required to pay the plaintiff’s attorneys fees which could cost local governments significant amounts if they intentionally or otherwise

violate the state pre-emption laws regarding firearms.

 

The decision of the court of appeals may be challenged by asking the Tennessee Supreme Court to consider the matter.  Until further notice, we will be holding our Gun Shows

at the Wilson County Expo Center in Lebanon, TN as we consider appealing to the TN Supreme Court.

As set forth on the attached ATF "Gun Show Guidelines", any seller holding a federal firearms license is required to follow the exact same set of laws and regulations when doing business at a gun show that they must follow when doing business at their store -- including FBI background checks on ALL firearms transactions.

A private party who does not hold a federal firearms license, however, is not required by state or federal law to conduct a FBI background check when selling a firearm to another private party (Nor is it even possible for non-licensee, private parties to conduct FBI background checks, because such are only available to those holding a federal firearms license)  Accordingly, non-licensed, private parties may sell firearms at gun shows in accordance with state and federal law, as long as such sales otherwise fully comply with all provisions of federal and other applicable law (i.e., they cannot transfer guns to people they know or have reason to believe are prohibited from possessing the guns such as felons, illegal aliens, mental defectives, etc.).  This is the Federal law throughout United States, and it applies to all private sales regardless whether they occur at gun shows, a private residence, or anywhere elsewhere.             

Accordingly, to the extent that anyone engages in conduct as a buyer or a seller of a firearm, whether at a gun show or anywhere else, that is in any way in violation of any applicable law, they should be prosecuted to the fullest extent of the law.  ____________________________________________________________________________________________________

NON-RESIDENTS:   CAN NOT BUY, SELL OR TRADE FIREARMS TO PRIVATE INDIVIDUALS.  YOU MAY SELL FIREARMS TO ANY FFL DEALER, REGARDLESS OF THEIR RESIDENCY.  YOU MAY BUY LONG GUNS FROM A FFL DEALER WHO IS LICENSED IN THE SAME STATE, PROVIDED THE LAWS OF BOTH STATES ARE COMPLIED WITH.

RESIDENTS:   MAY SELL, BUY, TRADE FROM ANYONE WHO IS ALSO A RESIDENT.  YOU CAN NOT BUY, SELL OR TRADE WITH ANYONE WHO IS NOT A RESIDENT.  YOU MAY SELL FIREARMS TO ANY FFL LICENSE DEALER, REGARDLESS OF THEIR RESIDENCY.
